Terms of service

You must be at least 18 years old to use PlaneBase. By creating an account you confirm that you are 18 or older, that all information you provide is accurate and complete, and that you have the legal capacity to enter into a binding agreement.

Sellers must be based in one of the 42 countries supported by PlaneBase's payment infrastructure. A current list of supported seller countries is available at planebaseapp.com. Buyers may be located anywhere in the world.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must not share your account with any other person or create multiple accounts to circumvent platform rules.

PlaneBase is a marketplace that connects independent sellers with buyers. PlaneBase is not a party to any transaction between buyers and sellers. The contract of sale is between the seller and the buyer directly.

All prices are listed in USD unless otherwise stated. Completed sales are binding. Sellers may cancel an order before shipment with buyer agreement. Buyers may not cancel after payment unless the seller agrees or a dispute is upheld.

The following items may not be listed on PlaneBase:

PlaneBase reserves the right to remove any listing at its sole discretion without prior notice.

All payments are processed securely by Stripe. PlaneBase never stores your card details.

PlaneBase collects a 5% platform fee on the item sale price of each transaction. Shipping costs are not subject to the platform fee.

When a buyer completes a purchase the funds are held in the PlaneBase platform account. Funds are not transferred to the seller until delivery is confirmed by the buyer or seven days after tracked delivery, whichever occurs first. This escrow arrangement exists to protect both buyers and sellers and is a condition of using the platform.

Seller payouts are processed on a weekly schedule following the release of funds from escrow. PlaneBase operates a 21-day payment security window from the date of purchase during the beta period. This window may be shortened as the platform matures.

If a dispute is opened before delivery is confirmed the transfer of funds to the seller is suspended until the dispute is resolved by PlaneBase.

Buyers have 14 days from the date of confirmed delivery to open a dispute if an item arrives not as described, is damaged in transit, or does not arrive at all.

Disputes are reviewed by the PlaneBase team. If a dispute is upheld the buyer receives a refund. Refunds are processed manually by PlaneBase within 2 business days of a dispute being resolved in the buyer's favour. PlaneBase's decision on disputes is final.

PlaneBase is not responsible for items lost or damaged in transit where the seller has provided valid tracking information showing the item was dispatched. In such cases PlaneBase will assist both parties in filing a claim with the carrier.

The Custom Hub allows buyers to commission handmade or modified scale models from verified builders. Submitting a commission brief does not create a binding contract. A binding contract is formed when the buyer accepts the builder's quote and completes payment.

Payment for commissions is held in escrow and released to the builder upon confirmed delivery using the same mechanism as standard sales. Custom commission disputes follow the same process as standard sale disputes.

Builders are responsible for delivering a finished model that materially matches the accepted brief. PlaneBase does not guarantee the quality or accuracy of any custom commission but will mediate disputes in good faith.

Placing a bid on an auction listing is a binding commitment to purchase at that price if you are the winning bidder. The winning bidder must complete payment within 48 hours of the auction closing. Failure to pay within this window may result in the auction being relisted and the bidder's account being suspended.

Sellers may set a reserve price. If the reserve is not met no sale is completed and no obligation exists for either party.

PlaneBase is required by law to collect tax identification information from sellers and to report seller transaction data to relevant tax authorities, including EU member state tax authorities under DAC7, HMRC in the United Kingdom, the CRA in Canada, and the ATO in Australia.

By creating a seller account you consent to PlaneBase collecting your name, address, date of birth, tax identification number, and transaction data, and to reporting this information to applicable tax authorities as required by law.

You are responsible for declaring your PlaneBase income to your own tax authority and paying any taxes owed. PlaneBase does not provide tax advice.

All content on PlaneBase including logos, design, and software is owned by PlaneBase LLC or licensed to us. You may not reproduce, distribute, or create derivative works without our written permission.

By listing items on PlaneBase you grant PlaneBase a non-exclusive, royalty-free, worldwide licence to display, reproduce, and use your listing photos and content for the purposes of operating and promoting the platform. This licence ends when your listing is removed or your account is closed.

Your use of PlaneBase is subject to our Privacy Policy available at planebaseapp.com/privacy. PlaneBase processes personal data in accordance with GDPR, UK GDPR, and other applicable data protection laws.

PlaneBase is provided on an as-is basis. We do not guarantee the accuracy of listings, the conduct of users, or the condition of items sold through the platform.

To the fullest extent permitted by applicable law PlaneBase's total liability to you for any claim arising out of or relating to these terms or your use of the platform shall not exceed the greater of the total platform fees paid by you to PlaneBase in the 12 months preceding the claim or $100.

PlaneBase shall not be liable for any indirect, incidental, special, consequential, or punitive damages including lost profits, lost data, or loss of goodwill, whether arising from contract, tort, or otherwise, even if PlaneBase has been advised of the possibility of such damages.

PlaneBase reserves the right to suspend or terminate any account that violates these terms, engages in fraudulent activity, or causes harm to other users or the platform, at our sole discretion and without prior notice.

Upon termination any funds held in escrow for pending orders will be handled as follows: funds for orders where the item has been shipped will be held until delivery is confirmed or the dispute window closes; funds for orders where the item has not been shipped will be refunded to the buyer.

We may update these terms at any time. We will notify registered users of material changes by email or platform notification. Continued use of PlaneBase after changes are posted constitutes acceptance of the updated terms.

These terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.

Any dispute arising out of or relating to these terms or your use of PlaneBase shall first be addressed through good-faith negotiation by contacting us at planebaseapp@gmail.com. If the dispute cannot be resolved informally within 30 days either party may pursue their available legal remedies in the courts of New York County, New York, to which both parties irrevocably consent to jurisdiction.
